Mark F. Kluger

Partner

Mark practices exclusively in the area of labor and employment law on behalf of employers. For ten years, before founding Kluger Healey, LLC, he was Chairman of the Labor and Employment Department of one of New Jersey’s oldest law firms. Mark is a frequent speaker and writer on sexual harassment and discrimination avoidance, workplace diversity, performance management, union avoidance, and a myriad of other employment-related subjects and regularly conducts training sessions for employers on these critical topics. In addition, Mark has extensive experience in counseling employers on issues involving discipline and discharge, reductions in force, mergers and acquisitions, compliance with wage and hour, disability, COBRA, and family and medical leave laws. He regularly drafts all forms of employment policies and handbooks, severance agreements, employment contracts, non-competition and confidentiality agreements, and affirmative action plans. Mark also represents employers in collective bargaining, grievance arbitration, NLRB proceedings, and picket line issues. Mark graduated from Vassar College in 1984 and Cornell University Law School in 1987. He was an Adjunct Professor at Seton Hall Law School from 1991-1996, and served as a member and President of the Board of Education in North Caldwell, New Jersey from 2002-2008.

William H. Healey

Partner

Bill represents business and management clients in a broad range of employment and commercial matters.  He concentrates on the defense of discrimination, harassment, whistleblower, breach of contract, wrongful discharge, and wage & hour claims (including collective and class actions). He provides training on a variety of employment law topics, investigates workplace issues and complaints, and ensures compliance with state and federal requirements. He also regularly represents business and management clients in matters involving trade secrets, employee disloyalty and theft, shareholder oppression claims, independent contractor issues, partnership disputes, fraud and defamation claims, privacy issues, and non-competition, non-solicitation, and confidentiality agreements. He has been successful in all phases of civil practice and has been designated by the Supreme Court of New Jersey as a Certified Civil Trial Attorney (a distinction limited to less than 2% of the lawyers in New Jersey).  Before practicing law, Bill was a risk manager for a Fortune 100 manufacturing company in New Jersey, and a financial analyst for a major New York bank. Bill is currently an Instructor in the Paralegal Studies Program at Fairleigh Dickinson University.

David A. Ward

Partner

David specializes in the litigation of complex commercial disputes in various venues, including trials, appeals, arbitrations and mediations. He has successfully represented corporations and individuals in a wide variety of industries, including insurance and banking entities, national and international manufacturers and distributors, real estate developers, retailers, media entities and entrepreneurs. His cases have involved a broad range of legal matters, including insurance coverage disputes, fiduciary duty and director & officer liability claims, shareholder and partnership disputes, restrictive covenant, trade secret and intellectual property litigation, employment litigation, complex contract claims, real estate disputes, estate litigation, errors & omissions claims, and class-action suits alleging consumer fraud and other statutory or regulatory violations. David has enjoyed success at both the trial and appellate levels, and has successfully tried a number of cases in Federal and State courts in New York and New Jersey. He graduated Magna Cum Laude from William Paterson College, and received his law degree from Rutgers Law School-Newark, where he was an articles editor for the Computer & Technology Law Journal.

Phillip G. Ray

Partner

Phil specializes in employment law and civil litigation. He has extensive experience representing employers in wage and hour hearings and audits before Federal and State Departments of Labor.  He also regularly represents employers in Federal and State courts, labor arbitrations and administrative agencies including the Equal Employment Opportunity Commission, the New Jersey Division on Civil Rights, and State unemployment boards.  His litigation experience includes claims of harassment and discrimination on the basis of gender, pregnancy, age, race, religion, national origin and disability, as well as wrongful discharge, FMLA, CEPA, invasion of privacy, defamation, breach of employment contracts, retaliation and class/collective employment actions. He counsels business clients on issues relating to hiring, termination, discipline, disability leaves, Federal and State leave policies, drug testing, wage and hour policies, arbitration policies, harassment/discrimination training, privacy and restrictive covenants.  Before practicing law, Phil worked as a nurse.

Yanet Perez Noble

Of Counsel

Yanet specializes in the litigation of employment and civil matters. She has experience in both the private and government sector defending employers against claims of sexual harassment, discrimination, wrongful discharge and related torts, retaliation, wage and hour violations, breach of employment contract, invasion of privacy, defamation, and class/collective actions. Yanet counsels employers on issues related to hiring, termination, discipline, disability leave, family leave, drug testing, wage and hour policies, arbitration policies, reductions in force, and COBRA.  She also conducts training on sexual harassment and discrimination avoidance. Yanet is a former Assistant U.S. Attorney for the Office of the U.S. Attorney, District of New Jersey, under then-U.S. Attorney Chris Christie. Yanet represented and defended the United States, its agencies, and employees in a broad range of civil matters, including employment discrimination, tort, and immigration. Yanet was also a judicial law clerk to the Honorable John E. Keefe, Sr., then-judge of the Appellate Division, N.J. Superior Court, and to the Honorable Freda L. Wolfson, who was then a U.S. Magistrate Judge for the District of New Jersey (currently a U.S. District Judge). Yanet has a native fluency in Spanish.

Maureen Holahan-Saling

Of Counsel

Maureen’s practice focuses primarily on employment litigation in both state and federal court on behalf of private sector and public entity employers.  She has handled all aspects of litigation, up through and including trial preparation, in numerous cases and claims regarding all types of discrimination, harassment, wrongful termination, whistleblower retaliation, and breach of contract.  Maureen resides in Rumson with her husband and two children.
